Article 1: General provisions


The e-commerce website of SLAETS NV, a limited company with registered office at Jezusstraat 2-6 bus 9, 2000 Antwerp, VAT BE 0404 989 054, RPR ANTWERP, (hereinafter 'SLAETS' or 'Juwelier SLAETS') offers its customers the opportunity to purchase products from its web shop online.

These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce website ("Customer"). When placing an order via the Juwelier SLAETS web shop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to the applicability of these Terms and Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been accepted in advance, in writing and expressly by Juwelier SLAETS.

 

Article 2: Price

All prices stated are expressed in EURO, always including local Belgian VAT (21%) and all other taxes or duties payable by the Customer.

If delivery, reservation or administrative costs are charged, this will be stated separately.

The price quoted refers exclusively to the articles as literally described. The accompanying photos are for decorative purposes and may contain elements that are not included in the price.

The images of the products on the website(s) of SLAETS NV are displayed as realistically and accurately as possible. In order to enable the Customer to view a product up close, it may happen that certain products are depicted larger or smaller than in reality. The Customer must also always take into account the fact that each screen is set differently, which means that an image and the colour may deviate slightly.

 

Article 3: Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Juwelier SLAETS. Juwelier SLAETS is only bound to a means obligation with regard to the correctness and completeness of the information provided. Juwelier SLAETS is in no case liable in the event of obvious material errors, typographical errors or printing errors.

If the Customer has specific questions about e.g. sizes, colour, availability, delivery time or delivery method, we request the Customer to contact our customer service in advance.

The offer is always valid while stocks last and can be adjusted or withdrawn at any time by Juwelier SLAETS. Juwelier SLAETS cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

 

Article 4: Online purchases

Purchase intention
Before an agreement can be concluded between the Internet Customer and SLAETS NV, the Customer must first select a specific product and fill in the details requested by SLAETS NV. By doing so, the Customer merely and solely indicates his intention to possibly purchase a specific product. In addition to the products with a fixed price indication, the customer can also opt for products with an indicative price indication.

Offer & order confirmation:

At the moment the Customer announces his/her purchase intention, SLAETS NV will immediately make a specific offer to the Customer for the available SLAETS NV products that have a fixed price indication.

For the products with indicative price indication, SLAETS NV will send the Customer an offer - via e-mail - within a maximum of ten (14) days that matches the Customer's purchasing intention as closely as possible. The customer will then be able to purchase the product in question at a guaranteed fixed price for a maximum period of 5 working days.

Duration of the offer & associated order confirmation: Each offer by SLAETS NV to the Customer is made under conditions. Each offer is only valid for five (5) working days, starting from the moment the offer is transferred by SLAETS NV to the Customer.
If no agreement is reached within this period and SLAETS NV has not received any payment or confirmation of payment (by bank transfer), SLAETS NV has the right to either allow an extension of the offer or to consider the offer as cancelled – without notification to the customer. Therefore, only during this period are both the product and the proposed price as stated in the offer guaranteed.

Conclusion of the agreement:
The agreement is concluded at the moment that the Customer has accepted the offer without reservation, expressly declares that he/she has read and approved the General Terms and Conditions of SLAETS NV and SLAETS NV has handed an order confirmation to the Customer. In the event that the offer is made via the Website(s) of SLAETS NV, the order confirmation will be sent by e-mail to the e-mail address provided by the Customer. The agreement between the Customer and SLAETS NV always provides for an express resolutive clause. (see below)

Express resolutive clause: Every agreement entered into with SLAETS NV is subject to the express resolutive clause of payment of the price within the stipulated period. SLAETS NV relies for this purpose to the extent necessary on art. 1184 BW. If SLAETS NV has not received payment or confirmation of payment from the customer within 5 working days after the offer has been transferred by SLAETS NV, SLAETS NV can unilaterally terminate the agreement without any notification to the customer.

Valid agreement: In the event that the offer was made via the Website(s), the Customer and SLAETS NV expressly declare that a valid agreement can be made by using electronic forms of communication. The parties declare that the absence of a regular (physical) signature does not affect the binding force of the offer and its acceptance. The electronic files of SLAETS NV shall serve as proof.

Termination of Agreement: To avoid abuse, in the event that the Customer wishes to terminate the agreement made before the product is delivered, all costs associated with the chosen payment method will be deducted from the refund of the total amount paid by the Customer.

The Customer can choose between the following payment methods:

via credit card

via bank card

When payment is made by credit card, the terms and conditions of the card issuer in question apply. SLAETS NV is not a party in the relationship between the Customer and the card issuer. SLAETS is never responsible for any bank charges imposed by your bank. These bank charges are always for the account of the customer.

Juwelier SLAETS is entitled to refuse an order as a result of a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

If you choose to pay by credit card or bank card, the card will be debited immediately after confirmation of your order.

Determination and selection of the correct ring size:
SLAETS NV provides various means (printable document with ring sizes, possibility to measure the ring size in our points of sale, etc.) so that the customer is able to determine the correct ring size before placing his order, even remotely. Once the ring size has been determined by the customer (regardless of which of the aforementioned means was used for this), the choice and order of the correct ring size are the responsibility of the customer and not of SLAETS NV. This rule applies to all means of measuring the ring size, including the recording of the ring size with a standard metal ring gauge in one of our points of sale. Even in the latter case, taking into account the advice of our advisors, the choice of the ring size remains the responsibility of the customer and the customer is solely responsible for his choice. The customer must make his choice according to his own judgment (e.g. a slightly larger or smaller size, etc.). In addition, given the great variety in shape and style of rings and the artisanal nature of the product, SLAETS NV. is in no way able to guarantee that the thickness of the metal of the finished product corresponds 100% to the demonstration models (which are made available at the points of sale), which, given the difference between the models, may show slight differences in ring size. SLAETS NV. can never be held responsible for complaints regarding the order of the wrong ring size and will not cover the costs of return and size adjustment. These costs are always for the benefit of the customer.

 

Article 5: Delivery and execution of the agreement

5.1. General

Items ordered through this webshop will only be delivered in Belgium.

By “delivery” we mean, unless otherwise defined, the first delivery to the customer upon a purchase.

SLAETS NV will cover the shipping and insurance costs of this first delivery. Returns, 2nd or later deliveries after adjustments or repairs are the responsibility of the customer.

SLAETS NV will only ship the purchased product once it has received payment or at least confirmation of payment.

Purchases made through the website(s) of SLAETS NV are shipped by specialized transport companies that have experience in shipping valuable products. Depending on the delivery location, the purchased products are shipped by the following companies: Fed-Ex, UPS, DHL or De Post (exceptionally by other forwarders)

If SLAETS cannot meet the delivery time it has committed to, you as a customer have the right to cancel your purchase of the product displayed on www.SLAETS.com.

5.2. Delivery time

The estimated time depends on the delivery location on the one hand and the nature of the purchased product on the other. The delivery times mentioned are only indicative, therefore no rights can be derived from them.

The estimated delivery time is communicated in the offer and in the order confirmation sent to the Customer.

SLAETS NV strives to deliver or have delivered each purchased product as soon as possible. As a rule, the Customer must take into account a delivery period of 30 working days. This period commences upon receipt of payment on the bank account of SLAETS.

SLAETS NV will attempt to report any delays to the Customer as soon as possible by telephone, e-mail or fax.

SLAETS NV has no control over the actual timely delivery of the purchased product. Therefore, a later delivery does not entitle the customer to financial compensation or cancellation of the order.

In the exceptional case of non-delivery or loss of a package, SLAETS will do its utmost to limit the inconvenience. Since all our shipments are fully insured against non-delivery of a package, the option will be presented for a full refund or the production of a new jewel, without additional costs. Please note, however, that this procedure can only start once we have received official notification from the courier confirming the loss and/or non-delivery of the package. In addition, since our couriers are external partners, the customer agrees that SLAETS is not the main guilty party in the event of such an exceptional event. Therefore, the customer is fully informed that SLAETS will not give in to unreasonable behavior or legal threats requiring SLAETS to take corrective measures that go beyond its responsibility as described above.

Upon delivery of the purchased product, the customer will be required to show some form of identification before the shipping company can deliver the product.

5.3. Delivery address

Deliveries will be made to the address provided by the Customer at the time of sending a request for information or accepting the offer. The Customer may be asked to sign the delivery note upon delivery of the purchased product. In order to prevent fraud, SLAETS NV advises the Customer to provide a (delivery) address that is stated on the credit card or is known to the Customer's financial banking institution.

Deliveries that take place at the points of sale, as stated on the website(s) of SLAETS NV, after payment by the customer or at the address provided by the Customer at the time of signing the invoice. If the Customer cannot immediately receive the purchased product and the parties agree to send the purchased product, the Customer may be requested to sign the delivery note at the time of offering delivery of the purchased product.

SLAETS NV also advises its Customers to check the presented shipping package for external damage, such as, but not limited to, cracks and dents, before signing the delivery note for receipt.

5.4. Packaging of the product

All products purchased and transferred for shipment are shipped by SLAETS NV in a sturdy, high-quality and neat box in which the purchased product is protected during shipment and which can be perfectly used as gift packaging.

5.5. Insurance of the shipped product

Each shipment provided by SLAETS NV in case of a first delivery to a customer after purchase is fully insured (risk-free). In this case, SLAETS NV assumes all shipping risks. In order to further guarantee the safety of the shipment, a signature may be requested at the time of presentation of the shipment (of the purchased product). SLAETS NV requests its Customers to ensure that he/she or a trusted person can receive the delivery.

As soon as the shipment (of the purchased product) has been delivered to the specified delivery address – whether or not before receipt – the risk passes to the Customer.

5.6. Partial delivery

If the delivery is made in parts (for example when only some but not all raw materials and/or ordered products are in stock), SLAETS NV can consider each delivery as a separate delivery. In this case, the Customer will be contacted by a representative of SLAETS NV to pay the additional transport costs.

5.7. Failure to collect the delivery

If the Customer does not or cannot receive the shipment (of the purchased product) or does not receive it on time, the shipment will be returned to SLAETS NV. SLAETS NV will inform the Customer that it retains the purchased product and will invite the Customer to collect the purchased product within a period of 1 month. The Customer can then either collect the purchased product after paying the return shipping costs to SLAETS NV or request, after first paying all shipping costs, to have the purchased product sent to a delivery address chosen by him/her.

For products that need to be collected at the points of sale, the Customer is requested to collect the purchased product within the agreed period. Failing this, SLAETS NV is entitled to demand payment of the purchase price of the part not collected, or to consider the agreement dissolved without judicial intervention (subject to repayment to the Customer of any advances already paid for the purchased product in question).

Any visible damage and/or qualitative deficiency of an article or other deficiency in the delivery must be reported immediately by the Customer to SLAETS NV.

The risk of loss or damage shall pass to the Customer from the moment he (or a third party designated by him, who is not the carrier) has taken physical possession of the goods. However, the risk shall pass to the Customer upon delivery to the carrier, if the carrier has been instructed by the Customer to transport the goods and this choice was not offered by SLAETS NV.

 

Article 6: Retention of title

The delivered items remain the exclusive property of SLAETS NV until full payment has been made by the Customer.

The Customer undertakes to inform third parties of SLAETS NV's retention of title if necessary, e.g. anyone who might seize items that have not yet been fully paid for.

 

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who purchase articles online from SLAETS NV in their capacity as consumers.

The Customer has the right to cancel the agreement within a period of 14 calendar days without giving any reason.

The withdrawal period will expire 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, physically takes possession of the goods.

To exercise the right of withdrawal, the Customer must inform SLAETS NV. (Jezusstraat 2-6 bus 9, 2000 Antwerp, 032135080, INFO@SLAETS.EU) of his decision to withdraw from the agreement by means of an unambiguous statement (e.g. in writing by post, fax or e-mail). The Customer may use the model withdrawal form below for this purpose, but is not obliged to do so.

The Customer can also fill in the model withdrawal form or another clearly formulated declaration electronically and send it via our website WWW.SLAETS.EU. If the Customer makes use of this option, we will immediately send the Customer an acknowledgement of receipt of his withdrawal on a durable data carrier (e.g. by e-mail).

To meet the withdrawal deadline, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods to SLAETS NV, Jezusstraat 2-6 bus 9, 2000 Antwerp, without delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to cancel the agreement to SLAETS NV. The Customer is on time if he returns the goods before the period of 14 calendar days has expired.

The direct costs of returning the goods shall be borne by the Customer.

The direct costs of an insured return of the goods shall be borne by the Customer. The costs are estimated at approximately 200 EURO.

The Customer is requested to return the items in their original condition and packaging, with all accessories supplied, and instructions for use. If the returned product is diminished in value in any way, Juwelier SLAETS reserves the right to hold the Customer liable and claim damages for any decrease in value of the goods that is the result of the Customer's use of the goods that goes beyond what is necessary to determine the nature, characteristics and functioning of the goods.

All returned items are carefully examined. The starting point here is that the consumer may only inspect the item as he would be allowed to do in a store. Returned items may be tried on, but may not be used. If an item has suffered a decrease in value due to use by the Customer, this will be charged to the Customer.

In case of loss of the diamond certificate or diamond grading report, SLAETS NV cannot take back the returned item.

Jewels with an engraving specified by the customer cannot be returned as these are considered personalized products. In principle, a custom-made jewel with a self-assembled central diamond falls under goods that are manufactured according to the consumer's specifications. Jeweler SLAETS must very specifically search for and purchase this self-assembled diamond. These goods are therefore not covered by the right of withdrawal. However, Jeweler SLAETS will always try to take back products if possible.

If the Customer revokes the agreement, SLAETS NV will refund all payments received from the Customer up to that point, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after SLAETS NV has been informed of the Customer's decision to revoke the agreement. In the case of sales agreements, SLAETS NV may wait with the refund until it has received all goods back.

Any additional costs resulting from the Customer's choice of a method of delivery other than the cheapest standard delivery offered by SLAETS NV will not be reimbursed.

SLAETS NV will reimburse the Customer using the same means of payment as the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged any fees for such reimbursement.

The Customer may not exercise the right of withdrawal for:

the supply or provision of goods or services whose price is subject to fluctuations in the financial market over which SLAETS NV has no influence and which may occur within the withdrawal period, such as gold and diamonds;

the supply of goods manufactured to the Customer's specifications or clearly intended for a specific person; such as personal engraving;

 

Article 8: Warranty

Under the law of 21 September 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee applies from the date of delivery to the first owner. Any commercial guarantee does not affect these rights.

To invoke the warranty, the Customer must be able to provide proof of purchase. Customers are advised to retain the original packaging of the goods.

For items purchased online and delivered to the Customer's home, the Customer must contact the Juwelier SLAETS customer service and return the item to SLAETS NV at his own expense.

If a defect is discovered, the Customer must inform Juwelier SLAETS as soon as possible. In any case, any defect must be reported by the Customer within 2 months of its discovery. After that, any right to repair or replacement will lapse.

The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.


Defects that manifest themselves after a period of 6 months following the date of purchase or, if applicable, delivery, shall be deemed not to be hidden defects, unless the Customer provides proof to the contrary.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to SLAETS NV, in the event of non-payment or late payment, the Customer shall owe, by operation of law and without notice, interest of 10% per year on the unpaid amount from the date of default. In addition, the Customer shall owe, by operation of law and without notice, a fixed compensation of 10% on the amount in question, with a minimum of 25 euros per invoice.

Without prejudice to the foregoing, SLAETS NV reserves the right to take back items that have not been (fully) paid for.

 

Article 11: Privacy

The controller, SLAETS NV, respects the Belgian law of 8 December 1992 regarding the protection of privacy in the processing of personal data.

The personal data you provide will only be used for the following purposes: the execution of the concluded agreement, the processing of the order, sending newsletters, advertising and/or marketing purposes.

You have a legal right to inspect and possibly correct your personal data. Provided proof of identity (copy of identity card) you can obtain written notification of your personal data free of charge via a written, dated and signed request to SLAETS NV, Jezusstraat 2-6 bus 9, 2000 Antwerp, INFO@SLAETS.EU. If necessary, you can also request to correct data that is incorrect, incomplete or irrelevant.

In case of use of data for direct marketing: You can object free of charge to the use of your data for direct marketing. To this end, you can always contact SLAETS NV, Jezusstraat 2-6 bus 9, 2000 Antwerp, INFO@SLAETS.EU.

We treat your data as confidential information and will not pass it on, rent it out or sell it to third parties.

The customer is responsible for keeping his login details confidential and using his password. Your password is stored in encrypted form, so SLAETS NV has no access to your password.

SLAETS NV keeps online (anonymous) visitor statistics to see which pages of the website are visited and to what extent.

Failure at any time by SLAETS NV to enforce any of the rights stated in these Terms, or to exercise any right hereunder, will never be considered a waiver of such provision and will never affect the validity of these rights.

 

Article 14: Changes to conditions

These Conditions are supplemented by other conditions to which explicit reference is made, and the general sales conditions of SLAETS NV. In the event of any conflict, these Conditions shall prevail.

Article 15: Evidence

The Customer accepts that electronic communications and backups can serve as evidence.
 

Article 16: Applicable law – Disputes

Belgian law applies, with the exception of the provisions of private international law regarding applicable law.

The courts of the Consumer's place of residence shall have jurisdiction in legal disputes. The Consumer may also turn to the ODR platform ( http://ec.europa.eu/consumers/odr/ ).
